Terms and Condition – HireOquick

This is an agreement between the entity that you represent and HireOquick. This agreement governs your use of HireOquick and all its services. 

HireOquick provides its service to you through its website located at HireOquick.com application programming interface, or any other web application that HireOquick may offer from time to time, subject to this Terms of Service agreement.

Acceptance of the terms:

You acknowledge that you have read, comprehend, and agree to be bound by this TOS by accessing or using the Service or Site. The terms “you” or “your” refers to such an entity and its affiliates if you are accepting this TOS on behalf of a company, business, or other legal entity, in which case you represent that you have the ability to bind that entity and its affiliates to this TOS. You are not allowed to accept this TOS and use the service if you lack such authority or disagree with it. Any acts you or any of your representatives, consultants, agents, or users take on the service will be regarded as having been made on behalf of your legal entity.

Description of Service:

HireOquick provides an array of services for online recruitment screening, skills assessment, coding tests, and managing applicants. These services are not meant for personal use. They are strictly meant for business use or for internal business purposes in the organization that you represent. You may connect to the service using any Internet browser supported by HireOquick. You are responsible for obtaining access to the Internet and the equipment necessary to use the Services. You can select from the pre-built templates provided by HireOquick, create and amend material using your user account, and if you so desire, publish and distribute such content.

Intellectual property:

This website is protected by copyright, and other proprietary rights and laws. This protection extends to questions, assignments, text, content, photos, and video among other things. In addition to any additional copyright notices or limitations present on the site, you also undertake to adhere to all relevant copyright, trademark, and other laws.

Modification of terms of service:

We reserve the right to change the Terms at any time and without prior notice to you by emailing your primary email address or posting a notice on our website. We shall give you at least 30 days notice through email at your primary email address if we make material modifications to the Terms that affect your rights. Your account will stop being accessible if your subscription is canceled or you don’t make the required payment. If the Terms are changed in a way that significantly affects your rights associated with using the Services, you may stop using the Services by sending HireOquick a written notice through email within 30 days of receiving notice of the new Terms. You won’t be eligible for a full or pro-rata return of the unused portion of any prepaid fees in the event of such termination, either. Your continued use of the service following the implementation of any modification to the Terms will be taken as acceptance of the new Terms.

User sign-up obligation:

To access or utilize the Services, you must register for a user account by completing all necessary information. We advise that you and every other user from your organization register for user accounts using your corporate contact information if you are an organization representative and desire to use the Services for corporate internal purposes. We advise you to use your company email address in particular. In order to join up, you promise to: a) supply true, accurate, current, and complete information about yourself; and b) maintain and quickly update the information you provided to keep it true, accurate, current, and complete. If any information you submit is false, inaccurate, out-of-date, or incomplete, or if HireOquick has a good faith belief that any such information is false, inaccurate, out-of-date, or incomplete, HireOquick has the right to suspend or terminate your user account and refuse any and all current or future use of the Services.

Organization Accounts and Administrators:

You can designate one or more administrators when you create an account for your business. The administrators will have the authority to manage end users in your company account and customize the Services in accordance with your requirements. It is possible that a third party can register and set your organization account on your behalf and also take on the administrator position for your company. Make sure you put into an appropriate contract with the third party outlining their obligations and limitations as the administrator of your organization account.

You are responsible for :

  1. i) ensuring confidentiality of your organization account password.
  2. ii) appointing competent individuals as administrators for managing your organization account, and

iii) ensuring that all activities that occur in connection with your organization account comply with this agreement. You understand that HireOquick is not responsible for account administration and internal management of the Services for you.

You must take the required action to make sure that your company maintains control over the administrator accounts. Sending an email to [email protected] will allow you to describe a procedure to be followed for regaining control in the event that the administrator accounts are lost, provided that HireOquick accepts the procedure. In the absence of a clearly defined administrator account; account recovery procedure, HireOquick may grant control of an administrator account to a person who can convince them that they have the right to act on the organization’s behalf. You acknowledge that any action taken by HireOquick in good faith in this regard shall not subject HireOquick to any liability for the results thereof.

Spamming & illegal invites:

You hereby agree not to use the Services for any unlawful activities or for the transmission of any unlawful, defamatory, harassing, libellous, abusive, threatening, harmful, vulgar, pornographic, obscene, or otherwise objectionable material, or for the transmission of any material that violates or may violate another’s intellectual property rights or other rights, or that is vulgar, pornographic, obscene, contains viruses or malicious code. You agree not to send “random assessment invites,” “spam assessment invites,” “phishing assessment invites,” or unsolicited bulk distribution of assessments using the Services. If we have reason to think that you have used the Services in any way that is unlawful or prohibited, we retain the right to discontinue your access to the Services.

User-generated content:

You are allowed to share or publish content you have produced, whether through one of the Services or another. However, the repercussions of such content’s transmission or publication fall completely under your purview. Any publicly accessible content on the Internet will be search engine crawlable and indexable. You are in charge of making sure that you don’t unintentionally reveal any sensitive information to the public. You agree not to use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit such content for any purpose without the express written consent of the person who owns the rights to such content. Any content that you might receive from other users of the Services is given to you AS IS for your information and personal use only. You agree not to remove any copyright notices or disable any copy protection features if, while using any of the Services, you come across any material containing one or more of these features. You confirm that you have the approval, authorization, or permission by making any copyrighted content available on any of the Services.

Disclaimer of warranties:

You agree not to use, copy, reproduce, distribute, transmit, broadcast, or otherwise commercially exploit any content that you may receive from other users of the Services. You explicitly comprehend and concur that using the services is at your own risk. The services are offered “as is” and “as available.” Excluding the implied warranties of merchantability and fitness for a particular purpose, HireOquick expressly disclaims any guarantees of any kind, whether express or implied. No guarantee is given by HireOquick that the services will be timely, secure, uninterrupted, or error-free. You are solely liable for any damage to your computer system, mobile phone, wireless device, or data that arises from the use of the services or the download of any such material, and you must use any material downloaded or received via the use of the services at your own risk. No statement made by HireOquick, its employees, or representatives in the form of advice or information, whether given in writing or verbally, will imply a warranty not already mentioned in the terms.

Indemnification:

You agree to indemnify and hold harmless HireOquick, its officers, directors, employees, suppliers, and affiliates from and against any losses, damages, fines, and expenses (including attorney’s fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party’s rights, in violation of any law, in violations of any provisions of the Terms, or any other claim related to your use of the Services, except where such use is authorized by HireOquick.

Suspension & termination:

We may suspend your user account or temporarily disable access to whole or part of any Service in the event of any suspected illegal activity, extended periods of inactivity, or requests by law enforcement or other government agencies. Objections to suspension or disabling of user accounts should be made to [email protected]  within thirty days of being notified about the suspension. We may terminate a suspended or disabled user account after thirty days. We will also remove your user account at your request.

In addition, we reserve the right to terminate your user account, deny the Services upon reasonable belief that you have violated the Terms, and close your access to any Beta Service in case of unexpected technical issues or discontinuation of the Beta Service. You will NOT be entitled to any refund (full or prorated refund) of any prepaid fees. Termination of the user account will include denial of access to all Services, deletion of information in your user account such as your email address and password, and deletion of all data in your user account.
